Subscription terms

Version 3. Last updated: 29 September 2026

These Terms govern your subscription to the DoorInspec+ service. Together with the Order Form and the Data Processing Agreement, they are the whole agreement between us.

1. The parties and the agreement

1.1 The service is supplied by Michael McCarthy, trading as DoorInspec+, registered business name number 768230, of Bantry, Co. Cork ("we", "us"). You are the organisation named on the Order Form ("you").

1.2 The agreement between us is made up of three documents: the Order Form, which carries your price and what is included; these Subscription Terms; and the Data Processing Agreement, which governs personal data.

1.3 Where they conflict, the Order Form prevails, then these Terms, except that the Data Processing Agreement prevails over both in respect of personal data.

1.4 These Terms may be accepted electronically within the Service. Acceptance has the same effect as a signature on paper.

1.5 The person accepting warrants that they are authorised to bind your organisation. A user account issued to an individual worker does not carry that authority.

1.6 On acceptance we record who accepted, for which organisation, when, and which version of each document. That record is available to you on request.

1.7 Where any of these documents is materially changed we will give you notice and the new version requires fresh acceptance. Continued use of the Service is not by itself acceptance of a materially changed version.

2. What you get

2.1 A non-exclusive, non-transferable right for your personnel to use the Service for your own business during the subscription, on the terms of the Order Form.

2.2 The Service is hosted by us. You do not receive a copy of the software and no ownership of it passes to you.

2.3 We may improve, change or withdraw individual features. We will not make a change that materially reduces the Service without thirty (30) days' notice, and if we do you may terminate without penalty.

3. Your people

3.1 The Order Form states how many people may use the Service. There is no minimum: you pay for the band you are in, and you may move down a band at any renewal.

3.2 Each person has their own named account. Accounts must not be shared.

3.3 You are responsible for what your personnel do with the Service, and for removing access when someone leaves.

4. Your data

4.1 The records you create are yours. We claim no ownership of them and we do not use them to develop, train or improve any product.

4.2 On request, at any time during the subscription and without charge, we will give you your records in a structured, commonly used, machine-readable format, together with the compliance documents generated through the Service in a durable form, within thirty (30) days of your request.

4.3 You are responsible for the accuracy of what you and your personnel record, and for the professional judgements recorded through the Service. The Service records what a competent person states; it does not make that judgement.

5. Availability

5.1 We target 99.5% availability of the Service in each calendar month, measured as the proportion of the month during which the Service accepts requests.

5.2 The following are excluded from that measurement: planned maintenance notified at least twenty-four (24) hours beforehand; any failure of your own equipment, network or mobile carrier; any outage of a third-party platform on which the Service depends and which is outside our control; and force majeure under clause 13.

5.3 Where availability in a month falls below 99.5%, you may claim a service credit of 10% of that month's fee for each full 1% below the target, to a maximum of 100% of that month's fee. Credits must be claimed within thirty (30) days of the month end.

5.4 Service credits are your sole remedy for missing the availability target, except where clause 11.3 applies.

5.5 The Service is designed to work without a connection. Records made offline are held on the device and sent when a connection returns. An interruption to the platform does not prevent work being recorded.

6. Support

6.1 We are a small supplier and this clause is written honestly. Support is provided by one person, by email, at support@doorinspect.ie.

6.2 We aim to acknowledge a support request by the end of the next working day, and to respond substantively within three (3) working days. Working days are Monday to Friday excluding Irish public holidays.

6.3 For a fault that prevents work being recorded and has no workaround, we aim to respond the same working day where the request reaches us before 16:00.

6.4 These are targets, not guarantees, and no service credit attaches to them. We would rather state a target we meet than promise a response time we cannot.

6.5 Support covers the Service. It does not cover your devices, your network, or advice on fire safety, which is your professional responsibility.

7. Fees and payment

7.1 Fees are stated on the Order Form and are payable monthly in advance by card, collected by Stripe. Fees are exclusive of VAT and any other tax, which you pay in addition where it applies.

7.2 Where the Order Form states a founder discount, that discount is fixed for the period stated on it. At the end of that period the standard price for your band applies, and we will give you sixty (60) days' notice before the first payment at that price.

7.3 We may change standard prices on sixty (60) days' written notice. If you do not accept the change you may terminate before it takes effect, without penalty.

7.4 If a payment fails we will tell you and try again. If it remains unpaid thirty (30) days after it was due we may suspend the Service on seven (7) days' further notice.

7.5 A suspended account keeps its data and keeps the right to a copy of it on request. We will not delete your records for non-payment.

8. Term, termination and switching

8.1 The subscription runs monthly and rolls over. There is no minimum term.

8.2 You may terminate at any time, effective at the end of the month you have paid for. No reason is needed and no penalty applies. Fees already paid are not refunded.

8.3 We may terminate on sixty (60) days' notice, or immediately if you materially breach these Terms and do not remedy it within thirty (30) days of being asked.

8.4 Switching, under the EU Data Act. You may switch to another provider or to your own systems. We will give you your records in a structured, commonly used, machine-readable format, together with the compliance documents generated through the Service in a durable form, within thirty (30) days of your request, without charge.

8.5 After termination your records remain available as a copy on request for thirty (30) days. After that we may delete them, and deletion completes within ninety (90) days, in accordance with the Data Processing Agreement.

8.6 THE RECORDS THE SERVICE CREATES MAY BE RECORDS YOU ARE REQUIRED BY LAW TO KEEP, including compliance records under fire safety and building control legislation, and records of hours worked, which an employer in the State must keep for at least three years. Take your copy before you leave. Clause 10.4 of the Data Processing Agreement says the same thing and it matters more than anything else on this page.

9. What we promise

9.1 We will provide the Service with reasonable skill and care.

9.2 We will not knowingly introduce malicious code.

9.3 We will keep the technical and organisational measures described in Annex 2 of the Data Processing Agreement.

9.4 Apart from what is written in these documents, the Service is provided as it is. We do not warrant that it will be free of every defect, or that it will meet a requirement you have not told us about.

10. What the Service is not

10.1 The Service is a recording tool. It is not a source of fire safety advice and it does not certify anything.

10.2 It does not determine whether a doorset, seal, wall or coating complies with any standard. It records what a competent person, exercising their own judgement, states about it, and it cites the documents that person relies upon.

10.3 You remain responsible for the competence of your personnel, for the correctness of what they record, and for the professional and statutory obligations that attach to the work. Nothing in the Service transfers any of that to us.

11. Liability

11.1 Neither of us excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

11.2 Subject to 11.1 and 11.3, our total liability in any twelve month period is limited to the fees you paid in the twelve months before the claim arose.

11.3 The cap in 11.2 does not apply to our liability for a personal data breach caused by our failure to keep the measures in Annex 2 of the Data Processing Agreement, or to our indemnity in clause 12.

11.4 Neither of us is liable for indirect or consequential loss, loss of profit, loss of business, loss of contract, or loss of anticipated savings.

11.5 We are not liable for a loss caused by a record that is wrong because of what was entered into the Service, by a professional judgement recorded through it, or by a failure to take a copy before termination.

12. Indemnity

12.1 We will defend you against a claim that the Service infringes a third party's intellectual property rights, and pay any award or settlement, provided you tell us promptly and let us conduct the defence.

12.2 You will indemnify us against a claim arising from the content you put into the Service, or from your use of it in breach of these Terms.

13. General

13.1 Confidentiality. Each of us will keep the other's confidential information confidential and use it only for the purposes of this agreement.

13.2 Intellectual property. We retain all rights in the Service. You retain all rights in your records.

13.3 Feedback. If you suggest an improvement we may use it without owing you anything. We will not use your records to build it.

13.4 Independent parties. Neither of us is the other's agent, partner or employee.

13.5 Force majeure. Neither of us is liable for a delay or failure caused by something beyond our reasonable control, except a failure to pay.

13.6 Assignment. You may not transfer this agreement without our consent, not to be unreasonably withheld. We may transfer it to a company we incorporate to carry on this business, on notice to you.

13.7 Entire agreement. These Terms, the Order Form and the Data Processing Agreement are the whole agreement between us about the Service.

13.8 Governing law. Irish law, and the courts of Ireland have exclusive jurisdiction.
